Welcome to Memory Stones. By accessing or using the Memory Stones platform at memorystones.com, our mobile applications, or any related services (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service.

1. The Service

Memory Stones provides a cloud-based platform for associating digital media files — including photos, videos, audio recordings, and PDF documents — with physical objects via unique identifiers encoded in QR codes and NFC tags. The physical tag stores only a unique identifier; all media files, user data, and access permissions are stored and managed in the cloud.

2. Accounts

You must create an account to use most features of the Service. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must be at least 13 years old to create an account.

3. Subscription Plans & Billing

The Service offers a free Trial plan and paid subscription plans (Family and Unlimited). Paid plans are billed monthly or yearly through Stripe. By subscribing, you authorize recurring charges. You may cancel at any time; access continues through the end of the current billing period. Refunds are not provided for partial billing periods.

When a paid membership ends — whether you cancel or a payment stops — your content is never deleted. You keep full access for a 30-day grace period, after which your account enters read-only Preserved Mode, where your memories remain stored and viewable. To keep your stones fully active, you may switch to a low-cost Preservation Plan, priced by storage used. You can download a complete copy of your content for free at any time. See our Cancellation & Preservation Policy for full details.

If no plan is active and no payments are made, your account eventually moves into Archived Mode, where your memories are kept in secure long-term storage and remain available for free download — but are never deleted. Reactivating an archived account requires resuming a plan plus a one-time Reactivation Fee based on how long the account was archived (no fee under 6 months, $24.99 up to 2 years, $49.99 beyond). This fee covers safely storing and retrieving your content during the archived period.

4. Your Content

You retain ownership of all files you upload. By uploading content, you grant Memory Stones a limited license to store, serve, and display your files solely for the purpose of operating the Service. We do not sell, share, or use your content for any other purpose.

5. Acceptable Use

You may not use the Service to store or distribute illegal content, malware, content that infringes on others' intellectual property rights, or content that exploits minors. We reserve the right to remove content and terminate accounts that violate these terms.

6. Intellectual Property

The Memory Stones platform, including its tag-to-cloud-media architecture, is protected by U.S. Patent No. 9,984,727 (“System for Playing Files Associated with Tagged Interest Items”). Your subscription grants a personal, non-exclusive, non-transferable license to use the platform. It does not grant any rights to the underlying patented technology.

7. Limitation of Liability

The Service is provided “as is.” Memory Stones LLC shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid in the 12 months preceding the claim.

8. Termination & Data Retention

We will never delete your memories automatically. If you cancel or stop paying, your content moves into Preserved Mode and, after an extended lapse, Archived Mode (see Section 3) — rather than being deleted. Your memories are permanently removed only when you, the account owner, specifically request deletion. You may download a complete copy of your content at any time, including after cancellation.

We may suspend or remove access to specific content, or terminate an account, if it violates these Terms — for example, content that is illegal or infringes others' rights (see Section 5). In such cases we will, where reasonably possible, give you notice and an opportunity to retrieve your other content before any action is taken.

9. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance. Material changes will be communicated via email or in-app notification.

Information We Collect

Account information: email address, display name, and password (hashed — we never store or see your plaintext password).

Content: files you upload (photos, videos, audio, PDFs) and metadata you provide (stone titles, descriptions, categories).

Scan data: when a stone is scanned, we record the tag ID, timestamp, and device type (mobile or desktop). If the scanner is logged in, we record their user ID.

Billing data: payment processing is handled entirely by Stripe. We store your Stripe customer ID and subscription status but never see or store your credit card number.

How We Use Your Information

Your information is used solely to operate the Service: storing and serving your files, enforcing access permissions, sending transactional emails (account confirmation, password reset, scan notifications), and processing billing.

Data Sharing

We do not sell your personal information. We share data only with service providers necessary to operate the platform: Supabase (database and storage), Vercel (hosting), Stripe (billing), and Resend (email). Each provider is bound by their own privacy commitments.

Data Retention & Deletion

We never delete your memories on our own. Your data is retained while your account is active and, if you cancel, in Preserved Mode and then Archived Mode afterward. You may delete individual stones and files at any time, and you can download a full copy of your content whenever you like. If you ask us to delete your account, all associated data is permanently removed within 30 days.

Security

Data is encrypted in transit (TLS) and at rest. Access to the database is controlled by row-level security policies. Authentication tokens expire and must be refreshed.
